Ernie Lopez was released from jail Friday after pleading guilty to injury to a child after new evidence surfaced.

Potter County District Attorney Randall Sims made the announcement Friday afternoon that charges for Lopez were changed and we would be released. Lopez was initially charged with aggravated sexual assault of a six-month-old baby he was babysitting back in 2000.

Sims states that there was a report done where the polygraph operator told Lopez that he had not passed his polygraph test and he became very emotional. "He made a couple of statement that the defense expert indicated were incriminating in his mind."

Since the beginning of the case, Lopez had declared his innocence. But now as a part of his plea bargain agreement, he can no longer say he is innocent or not guilty.
