HOUSTON (AP) - A teacher who witnessed another instructor allegedly beat a student in a videotaped attack at Jamie's House Charter School in Houston has resigned.

Principal David Jones says 33-year-old social studies teacher Gabriel Hahn Moseley did not report the April 29 incident.

Moseley resigned Monday. Calls from The Associated Press to a telephone listing for a Gabriel Hahn Moseley in Houston went unanswered Tuesday.

The pummeling of a 13-year-old boy was captured on cell phone video by another student.

Sheri Lynn Davis, who was fired last week, is under criminal investigation over the incident.

Moseley was on probation in a marijuana possession case and was hired in November. School spokeswoman Sue Davis says Jamie's House was willing to give Moseley a second chance.
