Judge Mary Lou Robinson has granted the dismissal of charges against Badr Djelti.

35-year-old Badr Djelti, according to court records, allegedly kidnapped his 2-year-old child, by taking the to Algeria but not returning with her.

Court documents show that he told his wife he left their child with his parents in Algeria.

Djelti, a legal citizen of Algeria, was legally living in the United States when he took his child to Algeria in December 2011.

In April, Djelti was ordered to make flight arrangements to Algeria within 48 hours so the child could be returned to the mother.

Federal authorities from the State Department International Parental Child Abduction Division would not confirm nor deny if the child has been found in Algeria.

Agents have also not confirmed of a return date if the child is being brought back to the mother.
