N.M. doctor seeks to block medical board action

ALBUQUERQUE, N.M. (AP) - An Albuquerque doctor is asking a New Mexico court to prevent the state medical board from taking administrative discipline action against him for allegedly prescribing medical marijuana when not warranted.

The suit filed last week in Santa Fe asks the 1st Judicial District Court to issue a temporary restraining order.

The suit says a notice the doctor received from the board is improper because he only certifies people who qualify to use medical marijuana and doesn't actually prescribe the drug.

The suit identifies the doctor only as "John Doe" and says his reputation would be irreparably harmed if public action is taken against him.

The Albuquerque Journal (http://bit.ly/UKeKk5  ) reports that its request for the doctor's name is pending but that the newspaper's previous requests for information have been denied.
