HOUSTON, TEXAS (AP) -- Houston police have charged a driver suspected of being intoxicated when his vehicle plunged into a rain-filled ditch and killed five children.
Houston police spokesman Kese Smith says 32-year-old Chanton Jenkins was charged with four counts of intoxication manslaughter yesterday evening.
Investigators say Jenkins failed a field sobriety test following the accident Saturday after torrential rain storms.
It's believed Jenkins lost control of his car while using his cell phone.
Jenkins was in custody last night. It was unclear if he had an attorney.
