Death penalty was thrown out by the U.S. Supreme Court

AMARILLO, TEXAS -- A Randall County jury will decide the fate of Brent Ray Brewer after his death penalty verdict was overturned by the United States Supreme Court.

Brewer was found guilty and sentenced to death for the killing of Robert Laminack, 66, in 1990. In April, the Supreme Court ruled that the jury wasn't allowed to sufficiently consider the abuse and neglect Brewer suffered as a child. Randall County District Attorney James Farren announced in May that he would re-try the punishment phase of the trial after finding there were sufficient evidence. Farren said he believed there is enough evidence to support the death penalty but didn't know if a jury would agree with him.
