Judge dismisses drug case against mariachi

A federal judge has thrown out a drug conspiracy indictment against a Mexican mariachi jailed for more than three months without seeing a judge or attorney.

CONROE, TEXAS (AP) -- The Houston judge said Friday that Alejandro Raul Martinez-Ramirez was deprieved of his right to a speedy trial. U.S. District Judge David Hittner left prosecutors with the option of refiling the case.

Hittner says the musician's 110-day detention was an administrative error and not done with malice.

The Houston Chronicle reports Martinez-Ramirez was arrested in April while in Edinburg. He was indicted on a count of conspiracy with intent to distribute a controlled substance and possession with intent to distribute a controlled.
