GRAY COUNTY, TEXAS -- At appellant's trial of Henry Watkins Skinner, some evidence was tested recently for DNA evidence.

State and federal district courts have both found that defense counsel had a reasonable trial strategy for not requesting the testing of the untested items in the previous trials.  The appellant now requests testing of items that still remain untested.

Skinner was convicted of fatally bludgeoning Twila Jean Busby,40, with an ax handle and then fatally stabbing her two mentally impaired sons, Randy Busby and Elwin Caler.

The killings took place at their home in Pampa on new year's eve in 1993.
