Probation revoked for man who threatened Obama

MIDLAND, Texas (AP) - A federal judge has revoked the probation of a man who pleaded guilty last May to threatening President Barack Obama and the Mall of America in suburban Minneapolis.

U.S. District Judge Robert Junell of Midland sentenced 21-year-old Timothy Ryan Gutierrez of Andrews to 18 months in prison after revoking his four-year probationary term.

Prosecutors sought the revocation after the electronic monitor Gutierrez was required to wear sounded 10 times. Prosecutor John Klassen also said Gutierrez failed to submit to mental health treatment, according to the Midland Reporter-Telegram.

Gutierrez said the monitor alarm sounded only when he went onto his front porch to smoke.

Gutierrez pleaded guilty May 4 in Denver to a charge of making threats by e-mail and was released on $25,000 unsecured bond.
