TYLER, Texas (AP) - A lawyer for a 17-year-old boy accused of stabbing his teacher to death in an east Texas classroom says an appeals court has temporarily stopped the youth's possible transfer to adult proceedings.
Attorney Jim Huggler said Friday that the 12th Court of Appeals granted his request for an emergency stay to keep the case in juvenile court, for now.
The teen is accused of killing Tyler John Tyler High School special education teacher Todd Henry in September.
Smith County Juvenile Judge Floyd Getz ruled Thursday that a hearing to determine whether the case moves to adult court could proceed.
Huggler argued that his client's mental health evaluation wasn't complete.
The teen was evaluated at the Vernon State Hospital, but is back in juvenile custody in Tyler, about 90 miles east of Dallas.
