NEW YORK (AP) -- A group founded by the Rev. Pat Robertson says it will challenge the vote that would allow construction of an Islamic community center and mosque near ground zero.

A lawyer with the American Center for Law and Justice says they'll file a petition today in state court against New York City's Landmark Preservation Commission. He says the commission "acted arbitrarily and abused its discretion" by refusing to give landmark status to the building involved.

Critics say the mosque would disrespect the memory of those killed at the hands of Islamic terrorists on 9/11. But New York Mayor Michael Bloomberg says "we would be untrue to the best part of ourselves...if we said no to a mosque in lower Manhattan."

Plans call for the center to rise 13 stories.
