CLOVIS, N.M. -- A Curry County inmate mistakenly released from custody last week is no longer being sought by law enforcement.
The Clovis News Journal, reports that Ramiro Chavez, 23, was released Thursday after a judge ordered him free on his own recognizance. However, officials say Chavez should have been held an additional 48 hours because of an immigration hold issued by Immigration and Customs Enforcement.
As of Monday, August 30, that hold expired, meaning local authorities no longer have cause to detain or hold Chavez.
Undersheriff Wesley Waller told the paper, that the hold is not a sentence, it's a "detainer" period, "there was a mistake made by the detention center but that does not stop the 48-hour period."
The bond order was issued by the magistrate court on Tuesday and the jail was faxed a copy Thursday, at which time the jail notified, ICE, and Chavez was released that evening. At the time ICE was notified, the 48-hour clock started.
