Critics try to derail NM emissions plan

ALBUQUERQUE, N.M. (AP) - A regional electric provider that serves thousands of rural New Mexicans is trying derail an effort by the New Mexico Environment Department to cap and trade greenhouse gas emissions.

Colorado-based Tri-State Generation and Transmission Association Inc. has filed an objection with the New Mexico Environmental Improvement Board that accuses the department of violating a state law designed to protect small businesses.

The law requires state regulators to notify the Small Business Regulatory Advisory Commission of any proposed regulations they are considering.

The commission may then review the proposed rules to determine whether they place an unnecessary burden on small business and make recommendations to limit the impacts.

The department says it followed the law and that Tri-State's action is a delay tactic.
