Amarillo family sues police over death

AMARILLO, TEXAS -- UPDATE: The attorney for the City of Amarillo, Marcus Norris, released this statement late Wednesday afternoon.

"We believe the decision by the grand jury to not indict the officers is a fair preview of a similar outcome that we anticipate in this civil law suit.

Based on what we know, we believe our officers acted bravely and properly in an extremely dangerous and rapidly evolving situation.

The City will vigorously defend this lawsuit. We will compel Mr. Quackenbush to produce his evidence in the courtroom for this civil trial.

We will not make further public statements about this pending litigation."

The family of a Texas man fatally shot by police while allegedly driving toward officers during a downtown brawl has filed a $10 million federal lawsuit.

The civil rights lawsuit is on behalf of survivors of 24-year-old Claudio Trujillo of Amarillo.

A Potter County grand jury last week found no wrongdoing by Amarillo police during the incident early Jan. 30. Police have said that Trujillo refused to stop. He died several days after being shot multiple times.

The Amarillo Globe-News reported Wednesday that the lawsuit accuses police of gross negligence, excessive force and failure to properly train officers.

Trujillo family attorney Jesse Quakenbush the city was asked to settle the case but refused.

City Attorney Marcus Norris said late Tuesday he had not yet seen the lawsuit.
