West family reacts to Grand Jury ruling

AMARILLO, TEXAS -- The 81 year-old man who was assaulted at Sky West, then died a short time later.

The West Family says they were very happy with the efforts made by the canyon police department in the case, but they don't have that same feeling about what the grand jury did.

When the police questioned 65 year-old Joe Rubalcaba, Bill's daughter Terry Wester says he informed the police of his formal martial arts training.

"He said Joe showed him which knuckles that he learned in martial arts do the most damage and that's the ones he used."

Canyon Police Chief Dale Davis says they conducted a thorough investigation so they would leave no stone unturned.

"Conducted a significant amount of interviews as well as of course talked to the people at Sky West and we put a fact finding investigation together and presented it to the D.A.'s office."

Terry and Matthew, Bill's grandson, had a meeting with the D.A. before he presented his case to the grand jury to make sure they had cleared the air.

"Our concern was just; we just wanted to make sure due to the inaccurate stories that had been reported that the information they had was factual."

The grand jury decided to no-bill Rubalcaba, meaning no charges would be brought against him, and that did not sit well with Bill's family.

"It was a homicide, Joe knows he was guilty, he was guilty. The grand jury showed leniency, I don't know what they're thinking it was, it would be interesting to know, but I don't think I'll get to find that out," said Wester.

We called Assistant Randall County D.A. Richard Gore to find out why Rubalcaba was not charged, but he could not elaborate.

"Anything that is presented to the grand jury or anything they discuss in their deliberations is confidential by law."

Matthew West also told us, they don't want this story to go unheard, because they want to try and prevent it from happening to anyone else in the future.
