Criminal Court overturns Lopez conviction

AMARILLO, TEXAS -- On Wednesday, the Texas Court of Criminal Appeals overturned the conviction of an Amarillo man who is serving 60 years in prison for aggravated sexual assault.

In 2003, Earnest Galvan Lopez was convicted of assaulting six month old Isis Charm Vas, who died in October of 2,000.

Potter County District Attorney Randall Sims says once the order is final and the judge has jurisdiction in the case, he will present a bench warrant to get Lopez returned to Potter County.

"Where the case is at is the same place any other case would be right after it's been indicted by a grand jury. It'll be on a trial docket, obviously I would assume since it's going to be an older case it'll get bubbled to the top pretty quick."

Sims went on to say the criminal appeals court has determined the trial counsel for the defense was insufficient, and therefore the case should be reversed.
