AMARILLO, TEXAS -- A 38-year-old man is now being charged with murder after officials said his reckless actions caused the death of another man.
On March 31, Justin Rupe, 39, and Bobbie Jean Baker, 33, were run over at a home in the 1100 block of SE 58th Street, police said.
According to police, the two had gotten into a confrontation with the occupants of a pickup located in the street. During the confrontation, someone came out of the residence with a pistol and fired shots at the pickup, police said.
The pickup then tried to flee the gunfire. As a result, Rupe and Baker were both run over, police said.
Neither of the parties involved in the altercation knew each other beforehand, police said.
Rupe died after being removed from life support, police said. Baker recovered from her injuries.
Police said they were originally given the identity of Mitchell Evans as the shooter. It was later determined he was not the shooter, but instead, the shooter was identified as 38-year-old J.B. Hayhurst.
According to police, Evans told them he was the one who shot the bullets because he was covering for Hayhurt who is a convicted felon. Evans is now being charged with Tampering with Evidence, a third degree felony.
Police said it was determined that the reckless actions of Hayhurt caused the death of Rupe. A murder charge has been accepted against him by the District Attorney's office.
He was arrested at 3:35 Monday afternoon, police said.
