DPS suggested homicide-related count for Colo. State Senator

AMARILLO, Texas (AP) - A Texas accident report had recommended a Colorado legislator cited for misdemeanor violations in a head-on wreck be charged with criminally negligent homicide.

The Amarillo Globe-News, through the Freedom of Information Act, on Wednesday obtained Department of Public Safety documents on the December accident in which Sen. Suzanne Williams was driving.

DPS investigators also recommended charges of tampering with physical evidence and injury to a child.

A grand jury in May declined to indict Williams.

Investigators say Williams might have been fatigued or distracted in the accident that killed a pregnant Amarillo woman in the other vehicle. Doctors saved the unborn son of Brianna Gomez. Her husband and their other two children were injured.

The lawmaker's son and two grandsons also were hurt.

Williams couldn't immediately be reached for comment.
