Curry County Magistrate Court wants to get the word out —  people with outstanding fees and fines don’t have to go to jail if they only pay what they owe.

The court has thousands of outstanding warrants for people who have either not paid fines or failed to appear for a summons, some more than 20 years old, according to Court Manager Jinger Fiola.

In an effort to get the word out and encourage people to come settle their debts with the court, Fiola said they decided to go public with their “failure to pay” list.

Court officials are hoping someone will see their own name on the list and come in to pay.

“If they want to come in and pay, we can take payment from anyone as long as it’s paid in full, so it doesn’t have to be the defendant coming in,” she said.

They are also hoping someone may contact the courts and let them know where people are or why they can’t be found.

The court’s first effort at going public with a list of outstanding warrants is strictly those people who have an outstanding debt. Paying in full will result in immediate cancellation of warrants.

There are 407 names on the failure to pay list, the oldest warrant being issued in 1994, with fines ranging from $16 to more than $1,400.

The list of 407 represents $129,485 in income for the courts.

“These are cases where we’ve (exhausted all collection efforts) and we just think it’s unlikely that they live in Clovis or surrounding areas and maybe someone will know them and let them know or pay for them,” she said.

Often they are traffic cases or misdemeanor charges, where someone was ordered to pay fines in conjunction with a conviction or plea agreement.

The court depends on money collected from fines and fees to keep the lights on and retain staff.

Warrants don’t expire and in a traffic stop anywhere in the state, she said police officers will discover the warrants and make an arrest.

“You don’t want to be going to a job interview and get pulled over and get arrested. Those things, they sneak up on you, they just don’t go away,” she said.

Police Capt. Patrick Whitney said often officers discover outstanding warrants in the course of their duties and will arrest, regardless of explanations or excuses from the individual. Because it is not the role of police to resolve the issues behind the warrant.

Anytime a driver’s license is run through the law enforcement system, outstanding warrants will show up, he said.

“(It happens) in our course of business. It could be anything from a traffic crash, to a traffic stop, to a domestic fight — pretty much anytime we have contact with people,” he said.
