AUSTIN, Texas (AP) - The Texas Supreme Court has granted a defense request to delay a hearing to determine whether a teenager accused of fatally stabbing his Tyler teacher should be tried as an adult.

Court spokesman Osler McCarthy says justices Thursday morning granted attorney Jim Huggler's request for an emergency stay of a juvenile court hearing set for Thursday afternoon in Tyler.

Huggler says the hearing can't be held without a more thorough mental evaluation of the youth.

Smith County Juvenile Court Judge Floyd Getz has said he has enough information.

The 17-year-old suspect was 16 when authorities say he stabbed his special education teacher, Todd Henry, at Tyler's John Tyler High School in September.
