A Hutchinson County man has been indicted on a charge of manslaughter for the April death of his three-and-a-half month old baby.
The Hutchinson County Grand Jury returned the indictment Wednesday for Johnathon Frank Athey. According to a release, the indictment alleges Athey recklessly caused his child's death. The infant's name was Dustin.
It was April 19 when Fritch EMS found an unresponsive infant in the 9600 block of Fritch Fortress Road. The infant was pronounced dead and a Lubbock Medical Examiner determine that he died of asphyxiation.
If convicted, Athey faced two to 20 years in prison. He could also receive probation from a jury.
