LUBBOCK, Texas (AP) - The Amarillo-based appeals court handling former Texas Tech coach Mike Leach's lawsuit over his 2009 firing has set Oct. 7 for oral arguments.

The school in Lubbock is appealing a trial court judge's ruling that, by its conduct, the university waived its right to sovereign immunity in Leach's breach of conduct claim.

Leach's attorneys are appealing the judge's dismissal of several other claims in the former football coach's suit.

The university fired Leach last Dec. 30, two days after suspending him amid allegations he mistreated a player with a concussion. Leach has denied mistreating Adam James.

Leach's attorneys have until Aug. 16 to submit briefs to the 7th Court of Appeals. The school's briefs are due the next day.

The hearing will be held at Lubbock Christian University.
