(AP) -- LUBBOCK, Texas (AP) - Texas Tech wants a judge to throw out fired coach Mike Leach's lawsuit against it, contending that state law gives the university immunity from legal action.
In documents filed Tuesday, the university contends that without a waiver of sovereign immunity from the Texas Legislature, Leach is barred from suing the university.
Attorneys for Leach, who was fired last month amid allegations of mistreatment of a player who suffered a concussion, filed additional claims Tuesday. Those include that the school violated the Texas Whistleblower Act in dismissing the coach.
One of Leach's attorneys said soverign immunity isn't allowed under a whistleblower claim.
In a statement, Leach said he'll "vigorously prosecute" his claims and expects to be "vindicated."
